Terms & Conditions

These Terms and Conditions (“Terms”) govern the use of services provided by Callum Welsh Visuals (“we”, “us”, “our”) and apply to all projects, engagements, and interactions with our website or business.

By accessing our services or website, you agree to these Terms. If you do not agree, please do not engage with our services.

1. Services

Callum Welsh Visuals provides creative and technical services including (but not limited to):

  • Video editing and production

  • Motion graphics and animation

  • Visual effects and compositing

  • 3D rendering

  • Technical documentation visuals

  • Branding, content development, and creative consulting

All services are offered on a freelance/project basis and scoped per individual client agreement.

2. Client Responsibilities

Clients agree to:

  • Provide accurate, timely information and feedback to support project delivery

  • Ensure they have rights to any third-party materials supplied for use in a project

  • Communicate clearly and respectfully throughout the engagement

Failure to provide required assets or input may delay delivery and/or impact outcomes.

3. Intellectual Property

Unless otherwise agreed in writing:

  • All original content created by Callum Welsh Visuals remains our intellectual property until full payment is received

  • Upon full payment, the client is granted a license to use the final deliverables for agreed-upon purposes (e.g. promotional, commercial, internal use)

  • We reserve the right to showcase non-confidential work in portfolios, reels, or promotions unless bound by a signed NDA

Source files (e.g. project files, raw footage, layered design files) are not included unless explicitly agreed.

4. Payment Terms

  • Quotes are valid for 30 days

  • A deposit or milestone payment may be required prior to project commencement

  • Payment is due within 14 days of invoice unless otherwise agreed

  • Late payments may incur a fee of 5% per month

Ownership of deliverables is not transferred until full payment has been received.

5. Revisions and Approval

Reasonable revisions are included as outlined in your quote or scope of work. Additional revisions or scope changes may incur extra fees. Clients are encouraged to approve work promptly to maintain timelines.

6. Cancellation and Termination

Either party may cancel a project by providing written notice. In the event of cancellation:

  • Work completed up to that point will be invoiced

  • Deposits may be non-refundable depending on the stage of the project

  • Final deliverables may be withheld until outstanding fees are paid

7. Limitation of Liability

Callum Welsh Visuals will make every effort to deliver professional, high-quality work. However, we are not liable for:

  • Any indirect or consequential damages

  • Losses incurred from delays caused by external factors

  • Client misuse of deliverables, or third-party claims arising from supplied materials

Total liability is limited to the value of the contract.

8. Confidentiality

All client information, materials, and communications will be treated as confidential unless otherwise stated. If required, we are happy to sign a Non-Disclosure Agreement (NDA) prior to starting work.

9. Use of Website

All content on this website is the property of Callum Welsh Visuals and may not be reproduced, repurposed, or distributed without permission. Website visitors agree not to misuse the content, contact forms, or branding for unsolicited or malicious purposes.

10. Governing Law

These Terms are governed by the laws of Queensland, Australia. Any disputes will be handled in accordance with the laws applicable in that jurisdiction.
